These Terms of Service govern your access to and use of Night Hue, including our mobile application, website, features, content, community tools, and related services collectively referred to as the Service.
By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service. We may update these Terms from time to time. The Last updated date will reflect the latest version. Continued use of the Service after changes are posted means you accept the updated Terms.
You must be at least 18 years old to use Night Hue. By using the Service, you confirm that you meet this requirement. We may suspend or terminate accounts that violate this requirement.
You are responsible for:
Night Hue may offer free features, paid subscriptions, premium features, or other paid access options. If paid digital features, subscriptions, or app-based services are offered in the iOS app, purchases may be processed through Apple In-App Purchase or another payment method where permitted by Apple and applicable law.
If you purchase a subscription through Apple, billing, renewal, cancellation, and refund handling are managed by Apple according to Apple’s terms and App Store settings. Subscriptions may renew automatically unless canceled before the renewal date. You can manage or cancel Apple subscriptions through your Apple account settings.
If purchases are offered outside the iOS app where permitted, those purchases may be handled by a separate payment provider and may be subject to additional payment terms presented at the time of purchase.
Night Hue is intended for creative collaboration, friendship, shared interests, and community connection. It is not a dating service, emergency service, crisis response service, or professional advice service.
You may not use the Service to:
You retain ownership of the content you create, upload, post, or share through the Service, including profile content, posts, comments, images, group content, messages, and other materials you provide.
By posting or sharing content through the Service, you grant Night Hue a non-exclusive, worldwide, royalty-free license to host, store, display, reproduce, adapt for technical formatting, transmit, and distribute your content as needed to operate, provide, protect, improve, and promote the Service.
You represent and warrant that you have all rights necessary to post or share your content and that your content does not violate the rights of others or any applicable law.
The Service, including its design, branding, features, software, text, graphics, logos, and other materials provided by Night Hue, is owned by Ann Peters or its licensors and is protected by intellectual property and other laws.
These Terms do not grant you ownership of the Service or any Night Hue intellectual property. You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from the Service except as permitted by law or with our written permission.
We may provide tools that allow users to report content, report users, block users, manage visibility, and control certain interactions. You agree not to misuse these tools.
We may review reports and take action at our discretion, including removing content, limiting features, warning users, suspending accounts, terminating accounts, or contacting appropriate authorities when necessary.

We may remove content, restrict features, suspend accounts, or terminate accounts that violate these Terms, our Privacy Policy, our Community Guidelines, or that pose a safety, legal, security, or integrity risk to the Service or other users.
You may stop using the Service at any time. If you create an account, you may request account deletion through the app where available or by contacting us.
Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, share, and protect information. Please review the Privacy Policy carefully.
The Service may include or rely on third-party services, platforms, links, hosting providers, analytics tools, payment processors, or other external services. We are not responsible for third-party services, and your use of those services may be governed by their own terms and privacy policies.
If you download or use Night Hue through the Apple App Store, your use may also be subject to Apple’s applicable terms, including the Apple Media Services Terms and Conditions and any applicable App Store rules.
Apple is not responsible for providing maintenance or support for the Service unless required by applicable law. For support questions about Night Hue, please contact us using the information below.
The Service is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not guarantee that the Service will be uninterrupted, secure, error-free, or available at all times. We are not responsible for user-generated content or interactions between users.
To the maximum extent permitted by law, Night Hue, Ann Peters, and their owners, officers, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of data, profits, goodwill, business, or reputation arising from or related to your use of the Service.
To the maximum extent permitted by law, our total liability for any claim related to the Service will not exceed the amount you paid to Night Hue in the 12 months before the event giving rise to the claim, or 100 dollars if you paid nothing.
To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmlessNight Hue, Ann Peters, and their owners, officers, employees, contractors, and service providers from claims, damages, losses, liabilities, costs, and expenses arising from or related to your content, your use of the Service, your violation of these Terms, your violation of law, or your violation of another person’s rights.
These Terms are governed by the laws of Florida, United States, without regard to conflict-of-law rules, except where applicable law requires otherwise.
We may modify, suspend, or discontinue parts of the Service at any time. We may also update, remove, or change features as needed to improve the Service, comply with law, protect users, or maintain security and integrity.
